1. Interpretation and Definitions
1.1 Interpretation
In these Terms, any capitalized word used herein has a specific, defined meaning that remains consistent regardless of the number of times it appears. References to “Terms,” “ToS,” “Agreement,” or similar expressions refer to this entire document.
1.2 Definitions
For the purposes of these Terms:
• Affiliate: Any entity that controls, is controlled by, or is under common control with Papyrus VIP SP. “Control” means the direct or indirect ownership of at least 50% of the voting rights or the power to direct management.
• Account: A unique identifier created for your access to our Service, enabling you to utilize various features and functions on our platform.
• Company: Papyrus VIP SP (referred to as “Papyrus,” “we,” “our,” or “us”), including all subsidiaries and affiliates.
• Content: Any data, files, text, images, or other information that you post, upload, or otherwise make available via our Service.
• Country: The United States.
• Device: Any electronic device (such as a computer, smartphone, or tablet) used to access the Service.
• Service: The advanced Distributed Denial of Service (DDoS) mitigation and network protection solutions offered by Papyrus VIP SP, including all associated platforms, tools, and customer support.
• Subscriptions: Recurring access to the Service provided on a monthly, semi-annual, or annual basis.
• Website: Refers to Papyrus.vip and any related domains (e.g., panel.papyrus.vip, blog.papyrus.vip).
• You: The individual or legal entity accessing or using our Service.
2. Acceptance and Scope
By subscribing to, accessing, or using any part of our Service, you confirm that you have read, understood, and agree to be bound by these Terms. Your continued use of our Service signifies your acceptance of any modifications made to these Terms. If you do not agree to every provision of these Terms, you must immediately cease using the Service.
3. Comprehensive Description of Services
Papyrus VIP SP provides a suite of specialized network protection solutions designed to secure your online operations. Our offerings include:
• Blaze: A specialized Layer 7 reverse proxy service engineered specifically for protecting Minecraft servers. Blaze features advanced domain-based routing and comprehensive DDoS mitigation techniques.
• Pyro: An advanced TCP/UDP proxy that delivers versatile Layer 7 protection with customizable filtering options and enhanced security features. Pyro is approved for use in configurations that require reverse proxy/load balancer functionality.
• VIP Plans: Our VIP plan is designed to be flexible and modifiable based on your individual needs. VIP customers can customize certain aspects of their service, provided that all modifications comply with these Terms.
• Enterprise Solutions: Tailored, client-specific security solutions for large-scale or highly specialized requirements. Enterprise plans include bespoke hardware deployments, dedicated support, and are governed by separate contractual agreements reflecting the unique nature of these solutions.
4. Prohibited Activities and Usage Restrictions
You agree that you will not engage in or facilitate any activities that may harm Papyrus VIP SP, its customers, or third parties. In particular, you must not:
• Engage in Illegal or Unlawful Activities: Use the Service for any purpose that violates local, state, federal, or international laws or regulations.
• Participate in Fraudulent or Malicious Behavior: Initiate DDoS attacks, unauthorized penetration testing, IP logging, malware distribution, phishing, or any other activities intended to defraud, disrupt, or harm network infrastructure or users.
• Host or Distribute Inappropriate Content: Upload or share content that is adult, explicit, unlawful, or that infringes on intellectual property rights.
• Violate Minecraft’s End-User License Agreement (EULA): Engage in practices (such as aggressive pay-to-win methods) that contravene the Minecraft EULA.
• Circumvent Network Limitations: Any attempt to extend, replicate, or circumvent the protected network(s) or any other boundaries defined in your subscription plan is strictly prohibited.
Papyrus VIP SP reserves the right to investigate any suspected violations and to take appropriate legal or technical action, including immediate suspension or termination of your Service without prior notice.
5. Billing, Payments, and Bandwidth Usage
5.1 Billing and Payment Cycles
• Subscription Options: Our Service is available under monthly, semi-annual, or annual billing cycles.
• Payment Processing: All payments are processed exclusively through our official website using Stripe.
• Custom Arrangements: VIP plans are modifiable. If you require custom billing arrangements or alternative payment methods, please submit a request via our Discord ticket system. All custom arrangements must be explicitly approved by Papyrus VIP SP and documented accordingly.
5.3 Bandwidth and Fair Use Policy
• Usage Expectations: Your bandwidth usage should ideally remain within the limits specified in your subscription plan. Usage beyond your allocated capacity is permitted, subject to overage fees. For services such as Blaze and WAF, traffic is governed by an unmetered fair use policy.
• Unmetered Fair Use Policy: If your usage significantly exceeds your plan limits and negatively impacts network performance or Papyrus VIP SP’s financial stability, we will contact you to discuss a service upgrade. Continued excessive usage may result in service suspension or termination if an upgrade cannot be arranged.
• Overage Fees: If your usage exceeds your plan’s allocated capacity by more than 0.1 TB, an overage fee will apply. In such cases, any excess usage is rounded up to a full TB. For example, if you exceed your allocation by 0.11 TB, you will be billed for 1 full TB of overage. The fee is $50 per TB for VIP customers and $25 per TB for Enterprise customers. For billing based on Mbps, a custom agreement will apply.
5.3 Subscription Cancellation Policy
Clients must notify Papyrus VIP SP of their intention to cancel their subscription at least two (2) days prior to the renewal date. Cancellation requests submitted less than two days before the renewal date or in response to overdue payment notifications will not be accepted and may result in immediate termination of your Service along with a possible ban on future access. It is your responsibility to ensure timely cancellation to avoid automatic renewal.
6. Refunds, Downtime Credits, and Exclusions
6.1 Refund Policy
• General Refund Window: Refund requests are accepted only within 36 hours following initial service activation or setup. Beyond this window, fees are non-refundable.
• How to Request a Refund: To request a refund, please notify us via Discord or email within 36 hours of service activation. In your message, indicate your intent to cancel your subscription and exercise your refund rights.
• Enterprise Plans: Due to the bespoke nature and dedicated hardware deployments of Enterprise solutions, refunds are not available for these plans. This condition applies irrespective of the customer’s location—including within the European Union (EU)—and is consistent with applicable consumer protection laws regarding custom products.
6.2 Downtime Credits
• Service Level Agreement (SLA): Papyrus VIP SP is committed to a 99.99% monthly uptime on our edge. Should our overall uptime fall below this threshold due to significant downtime events, downtime credits will apply as follows:
○ VIP Clients: If a qualifying downtime event causes your monthly uptime to drop below 99.99%—for example, an outage lasting as little as 7 minutes—you will receive a minimum credit of 5% of your monthly fee. For every additional full hour of confirmed downtime beyond that initial period, an extra credit of 2.5% of your monthly fee will be applied.
○ Enterprise Clients: If a qualifying downtime event causes your monthly uptime to drop below 99.99%, you will receive a minimum credit of 10% of your monthly fee, even for outages shorter than one hour. For every additional full hour of confirmed downtime beyond that initial period, an extra credit of 5% of your monthly fee will be applied.
These credits will be applied to your account in the subsequent billing cycle.
• Exclusions: Downtime credits apply solely to verified outages that render our entire edge network inaccessible. If only a portion of our network experiences issues, but traffic is successfully rerouted to ensure overall service continuity, the incident will not qualify for downtime credits. Additionally, scheduled maintenance, customer misconfigurations, and disruptions caused by third-party providers are excluded from downtime credit calculations.
6.3 Additional Provisions
• Chargebacks: Initiating a chargeback will result in the immediate termination of your Service and a permanent ban on future access.
• Manual Payment Reminders: In cases where automatic billing fails, we will contact you with instructions for manual payment. Failure to settle the invoice within the specified period may result in service suspension and extra fees.
7. Late Payments, Fees, and Financial Terms
• Payment Deadlines: Payments must be received within five (5) calendar days following the due date.
• Late Payment Fees: A daily fee of 5% of your monthly subscription value will be charged for each day your payment is overdue. If your payment remains unpaid for 10 days, your subscription will be canceled and your account will be permanently banned from future access.
• Courtesy Warning: The first instance of an overdue payment will result in a courtesy warning. Subsequent late payments will incur fees immediately.
• Service Impact: Persistent non-payment may lead to the suspension or termination of your Service, all associated data may be permanently deleted, and you may be permanently banned from future access.
8. User Accounts, Access, and Security
8.1 Account Registration and Management
• Accuracy: When creating an Account, you must provide accurate, complete, and current information. Failure to do so may result in the immediate termination of your Account.
• Username Guidelines: Usernames must not impersonate others, infringe on trademarks or copyrights, or be deemed offensive or inappropriate.
8.2 Security Responsibilities
• Confidentiality: You are solely responsible for maintaining the confidentiality of your account credentials, including your password.
• Activity Monitoring: All actions conducted under your Account are your responsibility. You must immediately notify Papyrus VIP SP of any unauthorized access or security breaches.
• Breach Reporting: If you suspect any compromise of your Account, please contact our support team immediately.
9. Network and Proxy Restrictions
9.1 Network Circumvention
• Defined Plan Boundaries: Each subscription plan includes specified plan allocations (e.g., a single network and/or backend server for VIP plans).
• Prohibited Circumvention: Any method, technique, or configuration designed to extend, replicate, or circumvent the plan boundaries or limitations included in your subscription is strictly prohibited. Attempts to bypass these limits will be treated as a violation of these Terms and may result in immediate termination of the Service.
10. Content, DMCA, and Copyright Compliance
10.1 Content Responsibilities
• User Content: You are solely responsible for all Content you host, post, or share via our Service. It is your duty to ensure that your Content is lawful and does not infringe on the rights of others.
• Prohibited Content: Content that is illegal, infringing, harmful, or otherwise objectionable is strictly forbidden.
• Removal Rights: Papyrus VIP SP reserves the right to remove or restrict access to any Content that violates these Terms or is deemed harmful, without prior notice.
10.2 DMCA and Copyright Procedures
• Reporting Infringement: If you believe that any Content on our Service infringes your copyright or other intellectual property rights, you must notify us in writing via a Discord ticket or by emailing abuse@papyrus.vip.
• Required DMCA Notice: Your notification must include:
○ An electronic or physical signature of the person authorized to act on behalf of the copyright owner.
○ A detailed description of the copyrighted work claimed to be infringed.
○ The specific URL or location of the infringing Content on our Service.
○ Your contact information (address, telephone number, and email address).
○ A statement of your good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
○ A statement under penalty of perjury that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.
• Papyrus’ Response: Upon receipt of a valid DMCA notice, we will promptly review the claim and may remove the infringing Content, suspend the associated Account, or take other appropriate actions. False or misleading claims may result in legal consequences.
11. Service Suspension and Termination
Papyrus VIP SP reserves the right to immediately suspend or terminate your Service without prior notice under any of the following circumstances:
• Violation of These Terms
• Unlawful or Fraudulent Conduct
• Payment Issues
• Plan Boundaries Circumvention
Upon termination, all data, configurations, and access credentials associated with your Account will be permanently deleted, and you will lose all rights to access or use the Service.
12. Intellectual Property Rights
All technology, software, network infrastructure, algorithms, and proprietary solutions—including but not limited to Blaze, Pyro, and the Papyrus VIP SP protection systems—are the exclusive property of Papyrus VIP SP. By using our Service, you are granted a limited, non-transferable license to use these solutions strictly in accordance with these Terms. No ownership or other intellectual property rights are transferred to you.
13. Limitation of Liability and Disclaimers
13.1 Limitation of Liability
• Monetary Cap: Papyrus VIP SP’s liability for any claims arising out of or related to these Terms or your use of the Service is limited to the amount you have paid for the Service in question.
• Exclusion of Damages: Under no circumstances shall Papyrus VIP SP be liable for any indirect, incidental, consequential, punitive, special, or exemplary damages (including loss of profits, data, or business interruption), even if advised of the possibility of such damages.
13.2 AS IS / AS AVAILABLE Disclaimer
• Service Provided “AS IS”: The Service is provided on an “AS IS” and “AS AVAILABLE” basis. Papyrus VIP SP expressly disclaims all warranties—express, implied, statutory, or otherwise—including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
• No Guarantee of Uninterrupted Service: We do not warrant that the Service will be error-free or uninterrupted. Your use of the Service is entirely at your own risk.
13.3 Force Majeure
Papyrus VIP SP shall not be liable for any delay or failure to perform its obligations under these Terms if such delay or failure is caused by events beyond its reasonable control, including natural disasters, acts of government, or other force majeure events.
14. Arbitration and Legal Dispute Resolution
Any dispute or claim arising from or relating to these Terms or the Service shall be resolved exclusively through binding arbitration under the laws of the State of New York, USA. By using the Service, you agree to waive your right to a court trial and instead submit any disputes to arbitration in accordance with these Terms.
15. Data Protection and Privacy
Papyrus VIP SP is committed to protecting your privacy and adheres to strict data protection standards. We collect only the minimum personal information necessary to provide the Service. All customer data is processed in accordance with our Privacy Policy and will be permanently deleted upon termination of the Service. You are encouraged to review our Privacy Policy to understand our practices regarding data collection, usage, and security.
16. Modifications to These Terms
Papyrus VIP SP reserves the right to amend or modify these Terms at any time without prior notice. Significant changes will be communicated via our official channels (e.g., our Website or Discord). It is your responsibility to review these Terms periodically. Your continued use of the Service after any modifications constitutes your acceptance of the updated Terms.
17. Reselling and Custom Enterprise Agreements
Reselling of Papyrus VIP SP services is permitted exclusively under our Enterprise Plans. Any reselling arrangement will be governed by a separate, detailed contractual agreement that specifies pricing, branding, technical requirements, and other conditions. Papyrus VIP SP reserves the right to negotiate and tailor these agreements on an individual basis.
18. Miscellaneous Provisions
18.1 Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, such provision will be modified or removed only to the extent necessary, and the remaining provisions shall remain in full force and effect.
18.2 No Waiver
Failure by Papyrus VIP SP to enforce any provision of these Terms shall not constitute a waiver of its right to enforce that provision in the future.
18.3 Entire Agreement
These Terms constitute the entire agreement between you and Papyrus VIP SP regarding your use of the Service and supersede all prior communications, agreements, or understandings, whether written or oral.
18.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without the prior written consent of Papyrus VIP SP. We may assign these Terms at our discretion without notice to you.
19. Governing Law
These Terms and your use of the Service are governed exclusively by the laws of the State of New York, USA. All disputes arising from or related to these Terms shall be resolved in accordance with New York law. Notwithstanding any other provision, the bespoke nature of our Enterprise plans and the restrictions on refund policies and network usage apply regardless of the customer’s location, including within the European Union (EU).
20. Notices
All notices or other communications required or permitted under these Terms shall be made in writing and delivered to the official contact addresses provided by Papyrus VIP SP. Notices may be sent via email, through our Discord channel, or by posting on our official Website. Notice is deemed given when received by the intended recipient.
